1. GENERAL PROVISIONS

The company reserves the right to copy photos and descriptions on the basis of the Act of February 4, 1994 on copyright and related rights, Journal of Laws 2017.0.880. Failure to comply with the copyright law may be prosecuted according to the provisions of the act. The company can share its photos by giving consent in writing along with the watermark. 2. ACCOUNT
- To create an account, it is necessary to fill in the contact form with the Customer's personal data in accordance with the form. Each account is assigned an individual login and password. Creating an account is voluntary and optional.
- You can make purchases without having an account.
- Having an account allows you to check your purchase history, entitles you to participate in contests and receive newsletters.
3. CONDITIONS FOR CONCLUDING A SALE AGREEMENT
- The customer has the option to place an order in the online store as a guest (without creating an account) or as a registered user (by creating an account).
- By completing the order form, the Buyer concludes a sales contract and accepts the store's regulations.
- The prices given on the website are in Polish zlotys.
- In the order summary, there is information about the total price of the subject of the order and about the delivery costs. The customer is informed about all costs when completing the order form.
- Store www.madelinefashion.pl it has no other hidden costs.
- After accepting the order, the Seller will immediately inform the Customer about the acceptance of the order for execution. Confirmation will be made by sending the Customer an e-mail to the e-mail address that was entered by the Customer into the form when placing the order.
- The order is saved in the online store system as proof of the contract.
- The contract is considered concluded at the moment the Customer receives the e-mail referred to above.
- The sales contract is concluded in Polish, with the content in accordance with the Regulations. The online store sells in the Republic of Poland and other European countries.
- Orders can be placed 7 days a week, 24 hours a day. This provision does not apply to Orders placed by phone.
- The Buyer may choose one of the following methods of placing an Order:
- placing an Order by completing the Order Form on the website www.Madelinefashion.pl
- placing an Order by e-mail: madelinefashionshop@gmail.com
- submission Orders by phone under the number: 510 050 269
- Orders submitted for execution may be canceled until the goods are shipped. This provision applies only to Buyers who are natural persons. In the case of other Buyers, Orders cannot be canceled.
- TERMS OF PAYMENT
When purchasing a product on the website www.madelinefashion.pl, payments are made according to the option chosen by the customer as follows:
- Payment by bank transfer to the Seller's bank account, the so-called prepayment on account - traditional courier delivery. Cost according to the current price list of the cheapest shipping company. Be priced individually for larger purchases after advance notice contact with us.
- Cash on delivery, i.e. courier delivery, cash on delivery. Cost according to the current price list of the cheapest shipping company. Be priced individually for larger purchases.
5. PAYMENT DEADLINE:
- If the Customer selects payment by bank transfer, electronic payment or payment by credit card, the Customer is obliged to make the payment within 4 calendar days from the date of the Sale Agreement. After this deadline is exceeded, the Sales contract is terminated due to the fault of the Customer.
- If the Customer chooses to pay in cash on delivery, the Customer is obliged to make the payment in cash on delivery.
6. ORDER SHIPMENT
- W przypadku wyboru płatności za pobraniem wysyłka następuje w ciągu 1-2 dni roboczych[1].
- W przypadku wyboru płatności przelewem, kartą płatniczą wysyłka następuje po wpłynięciu pełnej kwoty za dany produkt na rachunek bankowy Sprzedającego. Wysyłka następuje w ciągu 1-2 dni roboczych[2].
7. DELIVERY OF THE ORDER
- Product delivery is available on the territory of the Republic of Poland and abroad.
- The delivery of the Product to the Customer is payable, unless the Sales Agreement provides otherwise. The delivery costs of the product are public and are included in the "Delivery costs" tab and when placing the Order.
- The deadline for delivery of the product to the customer in the country is 1-4 business days (in accordance with the contract with the courier company).
- The customer is obliged to check the parcel in the presence of the courier. If a shipment is damaged, it is necessary to draw up a transport damage report and immediately notify the Seller of this fact by sending an e-mail. Failure to write a damage report with the courier will prevent the initiation of the complaint procedure, and thus the return of the goods.
- W przypadku nie odebrania paczki płatnej przy odbiorze kupujący jest zobowiązany w terminie do 7 dni uregulować koszt przesyłki w dwie strony zgodnie z obowiązującym cennikiem.
8. COMPLAINTS AND RETURNS:
- All complaints and returns should be submitted by sending a completed one form by e-mail to the following address: madelinefashionshop@gmail.com and by Polish post to the following address: Madeline, 95-050 Konstantynów Łódzki, ul. Moniuszko 13/1. ( we do not pick up injured parcels !! )
- The returned goods should be appropriateo to protect and pack and send it back complete in condition intact to the above address together with the receipt and attached complaint or return protocol, which are available for download at www.madelinefashion.pl

- The seller will respond to the complaint as soon as possible, no later than 14 calendar days from the date of its submission. Attention. The basis for initiating the complaint or return procedure is a correctly completed complaint or return form available on the website www.madelinefashion.pl and proof of purchase. Sending a different or incorrectly completed form may delay the consideration of the complaint.
- The full scope of the Seller's liability and obligations towards the Customer is defined by generally applicable laws, in particular in the Civil Code. For sales contracts, the basis and scope of the Seller's liability towards the Customer for non-compliance of the product with the sales contract are defined by the generally applicable provisions of the consumer sales law.
- In the event of any deficiencies in the parcel, please contact us immediately, no later than within 24 hours from the moment of receiving the parcel from the courier.
- The company does not bear the shipping costs in either direction, unless the company decides otherwise. For orders using free delivery - after returning products reducing the final amount - the shipping cost is borne by the buyer.
- W przypadku zwrotów produktów noszących ślady użytkowania – konsument będzie ponosił pełną odpowiedzialność za zmniejszenie wartości produktu . Zwrócony produkt musi być clean and devoid of any smell (perfume, deodorant, tobacco etc.)
9. RIGHT TO WITHDRAW FROM THE AGREEMENT
- A customer who is a consumer who has concluded a distance contract may, within 14 calendar days, withdraw from it without giving any reason and without incurring additional costs, except for the costs of transport to the Seller. The declaration of withdrawal from the contract may be sent by the Customer e-mail to the address: madelinefashionshop@gmail.com or by Polish post / courier to the following address: Madeline Magdalena Dobrodziej-Chojwa, 95-050 Konstantynów Łódzki ul. Moniuszko 13/1. within 14 calendar days.
- Sprzedawca ma obowiązek niezwłocznie, nie później niż w terminie 14 dni kalendarzowych od dnia otrzymania zwrotu produktu oraz oświadczenia Klienta o odstąpieniu od umowy, zwrócić Klientowi środki za zwrócone produkty. Sprzedawca dokonuje zwrotu płatności na numer konta podany w formularzu zwrotu – w tytule przelewu Zwrot Madeline . Jeżeli Sprzedawca nie zaproponował, że sam odbierze produkt od Klienta, może wstrzymać się ze zwrotem płatności otrzymanych od Klienta do chwili otrzymania produktu z powrotem.

10. PROVISIONS CONCERNING ENTREPRENEURS
- This section of the Regulations and the provisions contained therein apply only to business customers.
- The Seller has the right to withdraw from the sales contract concluded with the business customer within 14 calendar days from the date of its conclusion. Withdrawal from the Sales Agreement in this case may take place without giving a reason and does not give rise to any claims on the part of the Customer.
- In the case of business customers, the Seller has the right to limit the available payment methods, including requiring prepayment in whole or in part, regardless of the method of payment chosen by the Customer and the fact of concluding the sales contract.
11. FINAL PROVISIONS
- The Seller reserves the right to amend the regulations.
- In matters not covered by these regulations, generally applicable provisions of Polish law and other relevant provisions of generally applicable law shall apply.
EXPLANATION:
- WORKING DAY - one day from Monday to Friday, excluding public holidays.
- REGISTRATION FORM - a form available in the Online Store that allows you to create a Customer Account.
- ORDER FORM - Electronic Service that allows you to place an order.
- CUSTOMER - a natural person with full or limited legal capacity, who is not an entrepreneur.
- ACCOUNT - Electronic service with an assigned login and password in which the data provided by the Customer and information about orders placed by him in the Online Store are stored.
- NEWSLETTER - Electronic Service provided by the Seller via e-mail, which allows you to receive information from the Seller about Products, news and promotions in the Online Store.
- PRODUCT - a movable item available in the Online Store which is the subject of the Sales Agreement between the Customer and the Seller.
- SELLER - Madeline Magdalena Dobrodziej
- SALES AGREEMENT - a product sale agreement concluded or concluded between the Customer and the Seller via the Online Store.
- ORDER - Customer's declaration of intent submitted via the Order Form and aimed directly at concluding a product sales contract with the Seller.
